1. Acceptance of Terms

By accessing or using OMYRA ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legal agreement between you and OMYRA. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

OMYRA is an AI-powered triathlon training platform that provides:

• Personalized training plans for triathlon and endurance sports
• AI coaching through Maya, our intelligent training assistant
• Performance tracking and analysis
• Integration with fitness devices and platforms
• Training plan adaptations based on your performance

3. User Accounts & Age Requirements

Account Creation

To use OMYRA, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate personal information for safety reasons
• Ensuring compliance with age requirements

4. Data Usage & Integrations

OMYRA integrates with third-party fitness platforms under specific usage guidelines:

Garmin Connect & Apple HealthKit

• Used for AI coaching, plan adaptations, and performance analysis
• Data processed to provide personalized recommendations
• You grant us permission to analyze this data for training purposes
• You can revoke access at any time through device settings
• Complies with Apple HealthKit framework requirements

Strava Integration

• Used for activity display and historical reference only
• NOT used for AI processing or training recommendations
• Complies with Strava's API terms and usage policies
• You can disconnect Strava without affecting AI features

Manual Data Entry

• Workout data you manually enter is used for AI coaching
• Includes RPE ratings, notes, and performance metrics
• You retain ownership of all manually entered data

Billing Terms

• Subscription fees are charged in advance
• Prices are shown in Euros (EUR) and may vary by region
• All fees are non-refundable except where required by law
• We reserve the right to change pricing with 30 days advance notice
• Price changes apply to renewals after the notice period

6.5. Auto-Renewal & Cancellation Terms

7. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer or copy our AI technology
• Share your account credentials with others
• Upload malicious software or attempt to harm our systems
• Violate any third-party integrations' terms of service
• Use the Service to provide coaching to others commercially without permission
• Create multiple accounts to circumvent trial limitations
• Provide false age information or circumvent age verification

8. Health & Safety Disclaimers

Medical Consultation Required

You should consult with a qualified physician before:

• Starting any new training program
• Significantly increasing training intensity or volume
• Training with any pre-existing medical conditions
• Returning to training after injury or illness
• If you experience any concerning symptoms during training

Individual Responsibility

You are solely responsible for:

• Listening to your body and modifying training as needed
• Stopping exercise immediately if you experience pain, dizziness, or discomfort
• Seeking immediate medical attention for any training-related injuries
• Understanding your own fitness level and limitations
• Ensuring proper nutrition, hydration, and rest
• Using appropriate safety equipment and training in safe environments

Emergency Situations

OMYRA cannot and does not provide emergency medical services. In case of emergency during training:

• Stop activity immediately
• Seek immediate medical attention by calling emergency services
• Do not rely on OMYRA for emergency guidance

10. Intellectual Property

OMYRA retains all rights to:

• The OMYRA application and software
• Training algorithms and AI technology
• Maya's personality and coaching methodology
• Training plan templates and structures
• User interface and design elements
• Trademarks, logos, and brand elements

You retain ownership of your personal training data, but grant us a limited license to use it for providing the Service, improving our algorithms, and developing new features. This license ends when you delete your account.

11. Termination

Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion:

• Your access to the Service will be terminated immediately
• Your personal data will be deleted within 30 days
• Active subscriptions will be cancelled (refunds subject to app store policies)
• You may lose access to historical training data permanently
• Maya's AI model trained on your data will be deleted

Our Right to Terminate

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service or our Privacy Policy
• Engage in fraudulent, abusive, or harmful behavior
• Fail to pay subscription fees (where applicable)
• Use the Service in ways that harm our systems or other users
• Provide false age information or violate age requirements
• Attempt to circumvent technical or legal restrictions

12. Limitation of Liability

To the maximum extent permitted by law:

• OMYRA is provided "as-is" without warranties of any kind
• We are not liable for any injuries, accidents, or health issues resulting from training recommendations
• Our total liability is limited to the amount you paid in the last 12 months
• We are not liable for indirect, consequential, punitive, or special damages
• We are not liable for losses due to third-party service failures (Strava, Garmin, Apple)
• Some jurisdictions do not allow limitation of liability for personal injury or death

13. Governing Law

These Terms are governed by the laws of Spain and the European Union. Any disputes will be resolved through:

• Good faith negotiation between parties
• Mediation through European consumer dispute resolution
• Binding arbitration or in the courts of Catalonia, Spain
• EU consumer protection laws apply where applicable

European Consumer Rights

If you are a consumer in the European Union, you have additional rights under EU consumer protection law, including:

• Right to withdraw from distance contracts within 14 days
• Right to refund for digital services not performed as agreed
• Protection against unfair contract terms
• Access to alternative dispute resolution mechanisms

14. Changes to Terms

We may update these Terms as OMYRA evolves. We'll notify you of material changes via:

• Email notification to your registered address
• In-app notification with prominent display
• Updated "Last Modified" date at the top of this document
• Reasonable advance notice for material changes (minimum 30 days)

If you do not agree to the updated Terms, you may terminate your account. Continued use after the effective date constitutes acceptance of the updated Terms.
